Terms of Service
These Terms are a contract between you and Nifftly Labs Inc ("Nifftly"). By creating an account or using the Service, you agree to them.
Eligibility
You must be at least 13 years old to use Nifftly. If you are under 18, you may use it only with the involvement of a parent or guardian who agrees to these Terms. You confirm this when you register.
Your account
Provide accurate information, keep your password secure, and you're responsible for activity under your account. Tell us promptly of any unauthorized use.
The service & AI output
Nifftly lets you send prompts to third-party AI models and receive responses ("Output"). Output is generated automatically, may be inaccurate, incomplete, or offensive, and is provided "as is." It is not professional advice (legal, medical, financial, or otherwise). You are responsible for reviewing and how you use Output.
Niffs & ads
Nifftly meters usage in Niffs, a unit of AI spend budget. Free accounts receive a limited number of Niffs each day. You may optionally earn more by watching ads (served on the web by Google AdSense/Ad Manager and in the app by Google AdMob), or obtain them by buying a Niff pack or subscribing to Pro. Different models and features consume different numbers of Niffs — premium models and multi-step agent runs cost more than an everyday prompt, and require earned or purchased Niffs, or Pro. Current amounts are shown on our pricing page and in the app. Niffs have no cash value and are non-transferable. We do not currently expire Niffs; if that ever changes we will give notice before it takes effect.
Payments, subscriptions & auto-renewal
Prices are in U.S. dollars and charged via Stripe. Nifftly Pro is a subscription that automatically renews each month at the then-current price until you cancel. You can cancel anytime in the billing portal; cancellation takes effect at the end of the current billing period, and you keep access until then. We will give notice of material price changes.
Refunds
Except where required by law, subscription fees and delivered Niff packs are non-refundable, and Niffs already spent are non-refundable. If something went wrong with a charge, contact [email protected] and we'll work with you in good faith.
Acceptable use
Your use must follow our Acceptable Use Policy and the usage policies of the underlying providers (OpenAI, Anthropic, Perplexity, and Google/Gemini).
Intellectual property
We own the Nifftly app, brand, and content. You retain rights to the prompts you submit. As between you and Nifftly, and to the extent permitted by the providers' terms, you own the Output you generate; you are responsible for ensuring your use of it is lawful and doesn't infringe others' rights.
Your content & use by AI providers
You are responsible for the prompts and other content you submit ("Input") and for all activity under your account. You represent and warrant that you have the rights, licenses, permissions, and (where applicable) consents necessary to submit your Input and to allow it to be processed by our third-party AI providers, including for the development purposes below.
Some AI providers may use your Input and the resulting Output to develop and improve their services, including training their models and for related research, evaluation, and testing. We participate in OpenAI's content-sharing program: content we designate may be used by OpenAI for these purposes as an independent controller under its own terms. Do not submit sensitive, confidential, or proprietary information; Protected Health Information (as defined under HIPAA); or personal information of a child under 13 (or the applicable age of digital consent). Third-party services
The Service relies on third parties: AI providers (OpenAI, Anthropic, Perplexity, Google/Gemini), Stripe for payments, Google (AdSense, Ad Manager, and AdMob) for advertising, and Cloudflare for hosting. Your use of those features is also subject to their terms, and we aren't responsible for them.
Termination
You may stop using Nifftly or delete your account anytime. We may suspend or terminate accounts that violate these Terms or the Acceptable Use Policy.
Disclaimers & limitation of liability
The Service and Output are provided "as is" without warranties of any kind. To the maximum extent permitted by law, Nifftly Labs Inc is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the greater of the amount you paid us in the prior 12 months or US$50.
Indemnification
You agree to indemnify Nifftly Labs Inc against claims arising from your misuse of the Service or violation of these Terms.
Governing law & disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Before filing any claim, you agree to contact us to seek an informal resolution. Courts located in San Francisco, California will have jurisdiction unless applicable law requires otherwise.
